3. Intellectual Property Rights
3.1 Ownership
All text, product images, technical drawings, logos, brand marks, website layout, case content and video materials on www.mightlift.com are exclusive intellectual property of Mightlift. All rights reserved under international copyright, trademark and industrial design laws.
3.2 Permitted Usage
Registered B2B buyers may download product catalogs and parameter sheets for internal corporate procurement evaluation only. Any other reproduction, modification, redistribution, commercial reprinting or unauthorized image scraping for competing forklift supplier websites is strictly prohibited.
3.3 Prohibited Infringement
You shall not copy, mirror, crawl large-scale website data, or use Mightlift trademarks without written authorization. We reserve rights to issue legal notices, restrict website access and claim compensation for economic losses caused by IP infringement.
4. User Acceptable Use Rules
You agree not to conduct the following behaviors when using our website:
- Submit false company identity, fake contact information or malicious spam inquiry content.
- Deploy automated crawlers, bots, brute force tools to attack, overload or disrupt website server operation.
- Inject malicious code, virus or phishing links through comment/inquiry forms.
- Use the website for illegal industrial business, violation of import/export laws or counterfeit machinery production.
- Disseminate slanderous, defamatory, discriminatory or illegal content related to Mightlift products, factory or staff.
We reserve the right to block your IP address and refuse follow-up quotation services if you violate acceptable use rules.
5. Product & Quotation Disclaimer
- All product parameters, load capacity, lifting height and battery data displayed on the website are for reference only. Final technical specifications shall prevail in formal PI and sales contract. Minor product upgrades without prior notice are reserved for factory production optimization.
- Online quotation is a preliminary estimated price, not binding pricing. Final unit price, deposit ratio, Incoterms and delivery cycle will be confirmed after technical customization confirmation.
- Website images may contain optional auxiliary accessories; standard configuration scope is subject to written communication with our sales team.
- We guarantee CE, ISO and ANSI compliance for all exported forklifts, but import customs clearance responsibilities including tariff, inspection and local regulatory registration belong to the buyer’s side.
6. Limitation of Liability
- We maintain regular website maintenance but do not guarantee uninterrupted, error-free website access at all times. We shall not compensate for lost business opportunities caused by temporary website downtime.
- Mightlift is not liable for indirect losses, lost profits, warehouse shutdown losses or secondary economic damages arising from reliance on website preliminary product information before formal order signing.
- We are not responsible for third-party linked website content, third-party advertising accuracy or third-party platform transaction disputes.
7. Order & Sales Supplementary Rules (B2B Core Clauses)
- No binding sales contract is generated via website inquiry submission. An official order takes effect only after buyer pays agreed deposit and we issue signed proforma invoice.
- Payment terms, production lead time, shipping terms (EXW/FOB/CIF/DDP), after-sales warranty scope and spare parts supply rules are exclusively governed by separate sales contract documents, not these website Terms of Service.
- Bulk order delivery risks, cargo damage during sea/land transit and import duties shall be borne by the buyer unless otherwise agreed in written sales contract.
8. Force Majeure
Mightlift shall not be held liable for service delays or failure caused by events beyond reasonable control, including global supply chain shortages, national export policy adjustments, natural disasters, epidemic restrictions, port congestion and international logistics strikes. We will notify buyers promptly and coordinate rescheduling solutions when force majeure occurs.
9. Policy Modification Rights
We reserve absolute right to revise these Terms of Service at any time. Updated clauses take effect once published on the website Terms page. Your continued website browsing after update release constitutes full acceptance of revised terms. We recommend reviewing this page periodically.
10. Governing Law & Dispute Resolution
These Terms of Service are governed by the laws of the People’s Republic of China. Any dispute arising from website use shall first be resolved via friendly negotiation between both parties. If negotiation fails, disputes shall be submitted to the local people’s court where Mightlift’s factory is located for exclusive litigation judgment.
